There are a various employer sponsored visas and knowing which one is the right one for you can be tricky as they all seem very much alike.  There are common elements to all these visas in that the employee and employer have their own parts to play to be successful. 
If the employer does not meet the requirements to sponsor, they will not be able to do so - regardless that they currently employ you.  And if your occupation skill set is not deemed required by the Australian Government - you will not meet step one towards visa application.

The NEW 482 visa allows you to live and work in Australia for 4 years!

This permanent residency visa 186 is open to those under 45 years.  You must have an occupation on the appropriate list with relevant work experience and English level.
A positive Skills Assessment is mandatory.

​- what do we know....

So it's finally being released!  After much discussion and review (and just in time for the end of year deadline) the new Skills In Demand visa will commence and replace the current TSS 482 visa.  
What we do know so far is there is a new occupation list (which will also apply to the Direct Entry 186 Visa) - click here to see the list.
Apart from the initial information given to us (see this blog post), we are still waiting on more specific details.
Those that are on current TSS 482 visas can continue as normal towards PR.  However, there will be things to consider if you change employer, or require another 482 as your occupation will need to be on the new CSOL list.

​What do I need to do as the sponsoring Employer?

​The visa that is required by the migrant will determine what is needed from you as the employer. 
A SID 482 temporary visa will have 2 steps - sponsorship and nomination.  The Employer Sponsored 186 permanent visa, only requires a nomination.

Sponsorship

As an employer you will need to have a legally established and operating business.  You will need to demonstrate that your business has a good record towards employment practices, wage & salary payments, and a strong record or commitment to employing Australian citizens or permanent residents. 

Nomination

You will nominate the employee who requires the visa. You will need to prove to the Government that you are seeking to nominate this particular person because you have not been able to find an Australian citizen or Permanent Resident to fill the role and you are paying the person the correct salary or wage. 

How do I prove this?

Labour Market Testing (LMT)

LMT is the specific timeframe and method the Government wants the employer to advertise the position.  It is highly recommended you consult with a registered migration agent about this as failure to do this correctly will result in a refused nomination and delay the visa process.  At times, LMT is not required.  

Salary requirements 
The Government requires nominated employees to be paid a minimum amount - this is call the Temporary Skilled Migration Income Threshold (TSMIT).
This amount is $73,150 AUD.  You are not permitted to inflate the amount you pay your employee just to meet this minimum threshold.  You must demonstrate that the amount you are paying is inline with the market rate and any other employees you have that are also undertaking the same role. This will also index each financial year.

Skilling Australia Fund (SAF)
The purpose of the SAF levy is for employers to contribute to the broader skills development of Australians. The levy funds are managed by the Department of Employment and Workplace Relations (DEWR) and is calculated based on the length the visa will be granted for.  Employers are not permitted to pass on this levy to the visa applicant.

There are other items required to be lodged with the sponsorship and nomination application so as you can see, employing Great Australian Migration as your agent will ensure that everything is done correctly and you are successful.


​What do I need to do as the Employee visa applicant?

- Your occupation is on the list - You can only be sponsored if the position you are employed to is on the appropriate skilled occupation list.  On some visas, like a student visa, you can work in any position and at any level - but an employer sponsored visa is limited to those only on the list.    

- English level - You will need to demonstrate your English level through an approved test or hold an eligible passport to exempt you from taking the test.   

- Demonstrated skills and knowledge to perform the role - You will need to provide a CV and employment reference letters in support of your skills. Depending on the visa applied for - a skills assessment will be required and this must have been at least applied for prior to application.  Work experience will need to be from 2 to 3 years in the nominated position or closely related field. This should be in a full-time capacity gained in the past 5 years.  You may also need to show you have the required registrations or licences to perform your occupation.

Other important information for employers and visa holders

SOME OF YOUR OBLIGATIONS AS A EMPLOYER SPONSOR:

• ​Tell the Department in writing if the employee stops working for you or changes duties or position.
• Notify changes to your business structure or other issues such as insolvency.
• Ensure the employee only works within the nominated position.
• Keep accurate business records.

• Only work in your nominated position.
• If you change employers, you must wait for that new nomination to be approved before starting work.
